Sterilray Moves to Dismiss Healthe’s Simplified Complaint Alleging 222 nm Ultraviolet Technology Patent Infringement
The Honorable Roy B. Dalton, Jr., received a motion to dismiss yesterday in Healthe, Inc. v. High Energy Ozone LLC d/b/a/ Far-UV Sterilray, S. Edward Neister, and Pathogen Path Consulting LLC, Case No. 6:20-cv-02233-RBD-EJK (M.D. Fla.). Sterilray says Healthe’s patent misuse claims, causes of action based on inequitable conduct, and requests for declaratory judgments all fail as a matter of law and should not be permitted to proceed to trial.
