Nitride Semiconductors Urges Judge Suddaby to Reject Magistrate Peebles’ Conclusion Crystal IS’ AlGaN Recipe Doesn’t Infringe on UV LED Patent
In an objection filed this week, Nitride Semiconductors Co., Ltd., urges the Honorable Glenn T. Suddaby to reject a 45-page report and recommendation Magistrate Judge David E. Peebles released late last month saying Crystal IS, Inc.’s, motion for summary judgment should be granted on one patent infringement claim asserted by Crystal and denied on a second. Because Crystal combines Aluminum and Gallium organometallics simultaneously, Magistrate Peebles explains, there’s never a time when just Gallium is singularly present in the manufacturing process as described in Nitride’s patent.
