D Zine & Dr. Zaatari Say Scientific Debate About Ionizers Insulates Them from Global Plasma’s Lawsuit
In a Reply filed this week, D Zine Partners, LLC and Dr. Marwa Zaatari tell the Honorable Barbara M.G. Lynn that because there’s on-going scientific debate about ionizing air cleaning equipment safety and efficacy, nothing they’ve said about Global Plasma Solutions, Inc.’s products can be deceptive. “Without deception,” D Zine and Dr. Zaatari continue, “GPS’ house of cards tumbles: there is no Lanham Act advertising violation, no defamation, no business disparagement, no tortious interference with prospective business, and no common law unfair competition violation.” Accordingly, they conclude, Global’s lawsuit should be dismissed.
